Bond Set at $20,000 for Wheaton Man Accused of Criminal Sexual Assault/Illegal Videotaping of Women

DuPage County State’s Attorney Robert Berlin and Wheaton Chief of Police Bill Murphy announced today that Felony Criminal Sexual Assault and Unauthorized Videotaping charges have been filed against a Wheaton man accused of secretly videotaping the sexual assault of female acquaintances on at least two different occasions.

Matthew Tumbarello, 19 (d.o.b. 9/26/2000) of 226 W. Illinois, appeared in Bond Court this morning where Judge Brian Telander set bond at $20,000 with 10% to apply in accordance with a previously issued arrest warrant.

In all, Tumbarello has been charged with two counts of Criminal Sexual Assault (Class 1 Felony), two counts of Unauthorized Videotaping (Class 4 Felony), one count of Eavesdropping (Class 4 Felony) and one count of Misdemeanor Unauthorized Videotaping.

In early July 2020, one of Tumbarello’s alleged victims, who was in a dating relationship with the defendant, reported to the Wheaton Police Department that she was the victim of an alleged sexual assault and videotaping.

Wheaton police immediately began an investigation into the allegations. It is alleged that on several occasions Tumbarello used his cellular telephone to secretly record consensual sex between the two. It is alleged the victim did not know or consent to the recordings. It is further alleged that the defendant secretly recorded himself having sex with the woman while she was intoxicated and unable to consent.

It is further alleged that the investigation also uncovered several videos of Tumbarello having sex with two other women at separate times in which those women were also unable to consent. On July 23, 2020, Judge Robert Miller issued a $20,000 with 10% to apply arrest warrant for Tumbarello.

On July 28, 2020, Tumbarello was taken into custody following a traffic stop in Chicago. An investigation into the matter continues and anyone with information regarding this defendant is asked to call Lieutenant Cooley with the Wheaton Police Department at (630) 260-2077.

“The allegations that Mr. Tumbarello took advantage of several women who were unable to consent and secretly videotaped the sexual assaults are beyond disturbing and will be met with the full force of the law,” Berlin said.

“An individual’s right to privacy does not end simply because they are in a relationship with another person. I would like to thank the Wheaton Police Department for their work helping us prepare a strong case against Mr. Tumbarello. I would also like to thank Assistant State’s Attorneys Cathy Nusgart and Michael Fisher for their work on this case.”

“Charges like these are disturbing and my thoughts and prayers are with the victims,” Murphy said. “Our detectives did a tremendous job investigating the allegations, but the victims deserve credit for their bravery and willingness to help hold Matthew Tumbarello accountable for his alleged actions. State’s Attorney Bob Berlin’s office was unbelievably helpful throughout the investigation.”

Tumbarello’s next court appearance is scheduled for August 25, 2020, for arraignment in front of Judge Alex McGimpsey.    

Members of the public are reminded that this complaint contains only charges and is not proof of the defendant’s guilt. A defendant is presumed innocent and is entitled to a fair trial in which it is the government’s burden to prove his or her guilt beyond a reasonable doubt.
