Divorced dad recovered thousands in back child support

By Laura Reichel

A struggling Chicago dad survived a divorce several years ago. However, after the divorce, his ex refused to pay child support he badly needed to the point where she owed a sizeable chunk of money – many thousands of dollars.

Chicago matrimonial attorney Jeffery M. Leving and attorney and Litigation Director Art Kallow of the Law Offices of Jeffery M. Leving Ltd. will talk about this child support case and more on the Dads’ Rights Legal Hour, 9-10 a.m. CDT Saturday, July 27th, on Power 92.3 FM. This show will be available for download on the Dads’ Rights Legal Hour Spotify page on dadsrights.com.

While divorced dads often find themselves in the position of being child support payers, sometimes the dads are the custodial parents who are to receive child support and aren’t getting it.

The Leving team, through the use of Detective Halick’s crucial investigative services, investigated and discovered that the non-paying parent had the money, and lots of it! The Leving team, led by Attorney Art Kallow, in this case, meticulously prepared the evidence, went to court Downstate and skillfully litigated the case before the judge – and won! The judge found the delinquent parent in contempt and ordered the arrest of this parent. The money must be paid!

I’m not a big fan of tossing people in jail, but the fact that the judge included that remedy in the court order is an indication of the seriousness of the situation. This is a crucial victory for this father, modified for broadcast, and it brings up two very important points:

  1. If custodial parents are court ordered to be receiving child support, and their ex has never paid, but has the money, and lots of it, this is a matter that should be brought to the attention of the court, which can order enforcement. They need help.
  2. If non-custodial parents owe court ordered child support and are falling behind, but don’t have the money, they mustn’t ignore the problem. It won’t go away by itself. They need help. The Leving team will go to court, seek to make the judge aware of the circumstances, and argue for a downward modification or a stop to child support altogether.

Attorney and Litigation Director Arthur S. Kallow

Attorney Arthur S. Kallow was honored for his valuable contribution to the Domestic Relations Division of the Circuit Court of Cook County as a court facilitator. Kallow was also selected as an Illinois Super Lawyer. Super Lawyers are considered the best in their profession, and they represent the top practicing attorneys in Illinois and the country.
