Order of protection keeps dad from his daughters until he fights in court and wins
A father is going through a divorce, which is always difficult, says Fathers’ Rights attorney Jeffery M. Leving, who has been through a divorce himself. He has to worry about maintaining his relationship with his children and he has to worry about not being destroyed financially.
Leving, founder and president of the Law Offices of Jeffery M. Leving Ltd. in Chicago, will tell the story of a dad with two children – 9-year-old and 5-year-old girls – who is facing divorce.
He’ll speak about him on his weekly radio show, the Dads’ Rights Legal Hour, 9-10 a.m. CST Saturday, Nov. 12 on Power 92.3 FM in Chicago.
“Before we defended him, this father was hit with an ex-parte order of protection, meaning Dad wasn’t even present in court to defend himself when the order was issued against him – putting his liberty at risk,” Leving says.
“The order prohibited Dad from seeing his daughters, and we later learned the mother reported the father to DCFS, claiming he struck the children.”
Leving believes many divorce cases are rife with false or exaggerated abuse claims in support of orders of protection, which are then used in the divorce and parenting litigation. With this dad, Leving understood the abuse claims to be 100% fiction.
“This father was desperate to see his children – because he loves and cares for them, and because he feared losing them in divorce, if these allegations were not defended and were allowed to stand,” Leving says.
The Leving legal team has substantial experience dealing with falsely obtained orders of protection, and DCFS investigations based on dubious accusations. Meanwhile, the firm’s investigation appeared to show that the mother was actually endangering the children.
“We went to court to fight the order of protection against the father, and to exclude the allegations made in support of the order from the divorce litigation. We won. The order of protection was vacated, and Dad is now reunited with his children,” Leving says.
This was an important victory, modified for broadcast, that protected this father and his relationship with his children. “Had he not come to our office, he might not be with his children now, and he’d be in a bad position regarding his little girls as the divorce litigation played out,” Leving says. “I’m happy we could help him, the way we’ve helped many dads in his situation.”
