Dad is the primary caretaker of his two sons, ages four and five years old. Dad has a close relationship with his children and allowed the mother of the children to have parenting time with their little boys, even though she had no court ordered parenting time. Out of the blue, the mother refused to return the children to their father’s home. She even attempted to conceal the children’s location from dad. When dad and the police arrived at the children’s location, it was reported that the mother immediately threatened to kill dad if he took the children from her. Dad was able to safely retrieve his boys while the mother was detained.
Dad’s relief didn’t last long as he was soon contacted by his ex, who immediately demanded to see the children. Terrified for both his sons’ and his own safety, dad called attorney Leving for help. Leving assured the frantic father that his team would fight to protect him and his sons.
The Leving legal team immediately filed a Petition for Order of Protection on behalf of dad and his sons. They pointed out to the judge that the mother had already tried to take the children from dad, going as far as to threaten his life in front of them. The Leving team argued that allowing the mother anywhere near dad or the little boys could expose the children to a potentially dangerous situation. The judge ordered that dad have sole decision-making authority and ordered the mother have no parenting time or communication with the children.
Dad won. This is an important court victory, modified for publication, that protected dad’s children from being taken from their father and put in a dangerous situation. Dad can finally relax with his sons, knowing that his children are safe and protected.
Matrimonial attorney Jeffery M. Leving is the recipient of the Presidential Lifetime Achievement Award from the President of the United States, in recognition of his 7,500 hours of service to this great Nation.
