Leving Protected Dad from Crushing Child Support
By Laura Reichel
A desperate father feared that a child-support increase and a crushing retroactive judgment for past-due child support would leave him with an overwhelming financial burden he could never afford and land him in jail.
Dad was shocked when the mother of his daughter sought a significant increase in child support years after the court first set child support for dad’s now seventeen-year-old daughter.
He feared the possibility of an unreasonable support obligation he could not pay and a retroactive judgment that would take away all of what he had worked so hard to earn over the years.
Terrified of possibly being held in contempt of court and jailed, he turned to attorney Jeffery M. Leving for help.

The Leving legal team fought for him and won, protecting dad’s financial future, safeguarding his bond with his child and so much more.
Attorney Jeffery M. Leving will talk about this powerful court victory on his weekly radio show, the Dads’ Rights Legal Hour, 9 a.m. – 10 a.m. CDT Saturday, October 10th on Power 92.3 FM. The show will be available for download on the Dads’ Rights Legal Hour Spotify page at dadsrights.com
Illinois law allows child support to be modified when there has been a substantial change in circumstances. However, any new support amount—and any retroactive amount—depends on many factors, including the parties’ respective incomes, applicable statutory calculations, and the determination of counsel to zealously advocate for a result that is just. Dad wanted a winning outcome, one that preserved his ability to remain an active, present father who could still spend meaningful time with his child and also financially survive.
Desperate, dad called attorney Leving, who assured dad that the Leving litigation team would fight for him.
The Leving team carefully reviewed the financial information, performed the necessary calculations, imputed appropriate income to the adverse party, and forcefully litigated for a reasonable child-support amount. They also fought to protect dad from a retroactive child support judgment. They won. Dad can now continue to be with his daughter without fearing for his future and his liberty.
This court victory modified for publication is a reminder that fathers deserve strong, zealous advocacy, especially in highly contested litigation. For dad, this result was about much more than numbers. It was also about preserving his ability to take his daughter to dinner, support her interests, make lasting memories, and continue showing up for her in the ways that matter most as she grows into adulthood.
Matrimonial Attorney Jeffery M. Leving is the recipient of the Lifetime Achievement Award from the President of the United States in recognition of his 7,500 hours of service to this great nation. Leving co-authored the foundational Illinois joint custody law and has dedicated his career to safeguarding children and reuniting them with their fathers.
