No-contact order protects child from reported abuse
CHICAGO – Fathers’ Rights attorney Jeffery M. Leving secured a court victory for a father with a problem that many fathers have: Their children are living with their ex, and a man in the household is reportedly abusing the children.
It could be the mother’s new boyfriend, new husband or some other relative or friend.
This dad, whose 13-year-old girl was living with her mother in Ohio, contacted Leving with this exact problem: He said his daughter was being beaten, under the guise of “discipline,” by a man living with her mother.
“This is exceptionally concerning to me,” says Leving, founder and president of the Law Offices of Jeffery M. Leving Ltd. in Chicago.
“According to a study in Psychology Today, fatherless children are at greater risk of suffering physical, emotional, and sexual abuse, being five times more likely to have experienced physical abuse and emotional maltreatment, with a 100 times higher risk of fatal abuse.”
Leving will talk about this case on his weekly radio show, the Dads’ Rights Legal Hour, 9-10 a.m. CST Saturday, Feb. 18 on Power 92.3 FM in Chicago.
“Dad wanted the reported abusive man, a friend of the mother, out of the house. The mother didn’t agree, so we went to court,” Leving says.”
The Leving legal team prepared a strong case, and the girl was bravely willing to testify to the abuse. However, before the trial began, the adverse parties agreed to the Leving team’s suggestion of a no-contact order, preventing this man from having any contact with their client’s daughter, anywhere at any time. This court order protects the teenage girl, and spared her from having to testify.
Dad enthusiastically supported the no-contact order, and the judge approved it, so it has the force of law.
“This is a victory, modified for broadcast, with which Dad is exceptionally pleased, because he cares so deeply about the safety of his daughter – and I’m proud of our legal team for achieving it,” Leving says.
