Reported False Claim for College Expenses Thrown Out of Court

A struggling Illinois father was served with a summons to appear in court to defend against a Motion for College Expenses filed against him by his ex-wife for his estranged daughter.

The mother was seeking reimbursement for nearly four years’ worth of claimed college expenses that he could not possibly pay.

This anxious father had little to no contact with his daughter for many years, reportedly due to the alienating actions of the mother, and he had no idea whether his adult daughter was in school or not.

The father was defended by attorney Jeffery M. Leving against the enormous financial expenses that the mother was demanding that the father pay her for a child he barely knew.

“It was a tough case to win,” but I was determined to win it, said Leving.

Leving will discuss this case on the Dads’ Rights Legal Hour on Saturday, November 20, 2021, 9:00 to 10:00 a.m. CST on Power 92.3 FM.

Leving first sent a subpoena to the college the child had been reportedly attending. Leving was then contacted by the legal counsel for the college, only to be told that not only was the child not currently attending the college, but had never even attended the college.

The mother had provided what appeared to Leving to be false documentation in the matter, claiming that she had been paying for the child’s attendance at a college for nearly four years. Leving immediately filed a Motion to Strike and Dismiss the case. Leving’s client won; he was thrilled with this result. The mother’s Petition was not only dismissed by the court, but she was forbidden from ever filing this Petition again.

This is an important victory, modified for broadcast. Without Leving’s representation, this dad very likely would have been required to pay many thousands of dollars to the mother for college expenses he believed she never even incurred. He feels vindicated in his belief that the mother’s suspected deception was uncovered. He has no obligation to pay her a dime.

In addition to winning this case, Leving noted that at this holiday time, his firm cares about making sure this is a happy time for all children, especially those living in less-fortunate circumstances and without fathers. Leving said, “This year, my firm is proud to partner again with the WGN-TV Ch. 9 Toy Drive, which will donate toys to needy children through the Chicago Park District. Last year we donated two carloads of toys. This year we hope to have even more toys to donate.”

On the morning of Dec. 10, Leving will deliver toys to the Ch. 9 news on the air. I think this is a great way to help Chicago’s children have a happy holiday, especially those without parents.
