Father Transferred Overseas by Government Gains Time with Son

By Laura Reichel

A panicked, divorced dad who works for the U.S. government found himself in a tough situation.

He was being assigned overseas for a long period of time, and his ex reportedly denied his request to be with his son before his departure.

Dad feared that he wouldn’t be able to see his son or even say goodbye. Desperate, he called attorney Jeffery Leving for help.

The Leving legal team fought for him and won, ensuring that dad and his son would be together before dad’s departure overseas.

Chicago based matrimonial attorney Jeffery Leving, President of the Law Offices of Jeffery M. Leving Ltd., will talk about this important case victory and more on the Dads’ Rights Legal Hour, 9-10 a.m. CST Saturday, January 3rd on Power 92.3 FM. This show segment will be available for download on the Dads’ Rights Legal Hour’s Spotify page on dadsrights.com. Listen to this radio show for all children everywhere and share this victory and connect on Instagram @dadsrights. Every child matters.

While dad had parenting time with his pre-school son on weekends and some holidays, dad lived out of state but had been traveling back to Illinois to see his son. Unfortunately, travel was no longer viable. Furthermore, the government was now assigning him overseas, which reduced even further his opportunity to see his little boy, if at all.

What dad wanted was to see his son for three weeks, at his home, before he left for his overseas assignment. However, the reality was that with a divorce, an allocation judgment, and a parenting plan in place, and the mother objecting to the request, dad feared the judge wouldn’t provide him this opportunity.

Luckily for dad, he called the Law Offices of Jeffery M. Leving Ltd. for help. The Leving legal team immediately went to court to fight for dad and his son.

The Leving legal team argued before the judge that unusual circumstances had arisen. They asked the judge to recognize this devoted dad’s urgent need. The relief needed was extraordinary and not generally granted. This case could have gone either way. But the Leving team appealed to the judge’s sense of compassion, devotion to justice, and the best interests of the child. The hearing took two days, and they won. The judge granted dad what he wanted – parenting time with his little boy for three weeks at his home.

This victory modified for publication was a cause for jubilation for this loving father. Without it, he probably would have gone over a year without seeing his child.  It gave dad the precious time he needed to hold his son close, reassure him, and strengthen their bond before dad’s departure overseas.

Matrimonial attorney Jeffery M. Leving is the recipient of the Presidential Lifetime Achievement Award from President Joe R. Biden, Jr. in recognition of 7,500 hours of Leving’s service to this nation. Leving is also the recipient of the President’s Volunteer Service Award from President George W. Bush. Leving is a nationally recognized matrimonial and family law attorney.
