Dad who feared losing son forever, won in court, keeping son in the U.S.

An Illinois father wanted to keep his little boy from being ripped from his loving home and whisked out of the country, where he feared he’d never see his son again. Desperate, he called attorney Jeffery Leving for help. The Leving legal team won in court for him and his son – keeping them together and in the U.S.

Dad is loving father to his seven-year-old son. Under the divorce decree, the little boy lived with his mother. However, the child began living with dad after the mother had reportedly relocated to Colombia. The little boy was thriving while living in his father’s stable home in Illinois. Out of the blue, according to court documents, the mother announced that she was taking the little boy away from dad to live permanently outside the U.S.

Dad panicked. He was terrified of losing his son forever and he feared that if his ex succeeded in taking the little boy out of the country, he would never see his son again. Dad called attorney Leving for help, who assured him that the Leving legal team would fight to protect dad and his son in court.

The Leving team requested the judge order the little boy, a U.S. citizen, stay with dad in his safe and nurturing home here in Illinois, and to ban the mother from removing the child from the country. They fiercely argued the case, presenting carefully prepared evidence that showed how much the child thrived in his father’s home. The Leving team argued that separating the child from his father could have devastating effects on the child’s mental and physical health. The judge ordered that the child stay with dad in Illinois and ordered that the mother was prohibited from taking the little boy away. Dad won.

This was a victory, modified for publication, that protected a little boy from being taken from his father to another country, under who-knows-what circumstances. For dad, this court victory was a big relief: he went from fearing he would never see his child again, to having his son secure in his life and in his home every day.

Matrimonial attorney Jeffery M. Leving is the recipient of the Presidential Lifetime Achievement Award from the President of the United States in recognition of his 7,500 hours of service to this great Nation. In addition, the Illinois House of Representatives has honored Leving “for his work in safeguarding the rights of fathers and protecting the welfare of children and families in this State,” and the Illinois Senate issued a proclamation recognizing his efforts on behalf of fathers.
