Leving team court victory achieves justice for struggling father and his little girl
A desperate father contacted the Leving legal team for help after the mother of his little girl abandoned her.

Although Dad was never married to his daughter’s mother, both parents lived together with their 7-year-old daughter until the day the mother decided to walk out and leave the family behind.
After abandoning the child, the mother refused to provide any child support, leaving all of the financial responsibilities to Dad.
Dad quickly turned to the Law Offices of Jeffery M. Leving, Ltd. for help.
First, the Leving legal team secured a Court Order, which required the mother to pay child support to Dad, who was the sole caretaker of his daughter, struggling to support her. However, the mother violated the Court Order and refused to pay any child support. The team went back to Court to fight for their client. They filed a Petition for Rule to Show Cause, arguing that the mother had willfully violated the Court Order requiring her to pay child support. The Court agreed with the Leving team and found the mother in contempt, ordering her to pay the outstanding child support by the next Court date.
However, by the next Court date, the mother had still not paid any child support. When the mother continued to violate the Court’s Orders, the Leving team requested that the Court order the mother to be incarcerated, arguing that the mother, since abandoning her daughter had refused to pay any form of child support, and that she would continue to defy Court Orders unless she was incarcerated. The Court agreed and ordered the mother to be incarcerated in the Cook County Jail until she paid the child support that was due.
“This was a difficult case, modified for publication, but we won,” Leving says, “Now, Dad and his little girl can move on and enjoy a healthy and safe home with each other.
The mother had ignored her responsibilities as a parent and repeatedly violated multiple Court Orders. Incarceration is often a very effective method of achieving compliance with a Court Order. It can be a difficult remedy to obtain from a Court, but through their persuasive litigation skills, the Leving legal team was successful.
