Dad reunited with young daughter after ex-wife obtained baseless Order of Protection against him

A Chicago dad had a great relationship with his 5-year-old daughter. Even after he and his wife split up, they shared parenting time, and were very amicable – that was until his co-parenting relationship with his ex-wife crumbled when he moved on with a different woman.

Attorney and Litigation Director Art Kallow of the Law Offices of Jeffery M. Leving Ltd. will talk about this complex custody case involving multiple states on the Dads’ Rights Legal Hour, 9-10 a.m. CDT Saturday, May 25th, on Power 92.3 FM and on power92chicago.com.

All too often, a parent will retaliate against the other parent because they move on in a different relationship.  A common retaliatory tool can occur when a party seeks an Order of Protection against the other, falsely claiming they are being harassed or are in fear for their safety. Frequently, allegations within a Petition for Order of Protection are embellished, and sometimes even falsified by a scorned former partner.

That’s pretty much what happened to this Chicago dad who called the Law Offices of Jeffery M. Leving Ltd. for help when his ex-wife obtained an Order of Protection against him when she discovered he had found a new partner. A conviction for violating an Order of Protection is punishable by up to 1 year in jail. This is very serious.

The Leving team assured dad that they would fight for him, and they did. The team proceeded to court and secured an Order for Dismissal of the ex-wife’s Order of Protection.

The Leving legal team immediately went to work, appearing, and successfully arguing on the first court date for the removal of the child as a protected party from the Emergency Order of Protection entered by the judge against the father. The Leving team also obtained immediate court ordered parenting time for dad to start the reunification.

On the second return date to court, the Leving legal team argued to vacate and dismiss the entire Order of Protection the judge entered against their client. They succeeded. The court then granted dad the majority of the parenting time with his daughter. The Leving team obtained more parenting time for their client than he ever previously enjoyed.

“This victory, modified for broadcast, was crucial to reuniting this loving father and his little girl and keeping them together. Failure was never an option for our team!” said Jeffery Leving.

This father is now restored to his proper role of “Dad” rather than just a “visitor”, with more parenting time than he thought was ever possible.
