Boy rescued from ‘toxic’ home, reunited with dad
Renowned matrimonial attorney Jeffery M. Leving and his legal team won a case that took extensive, persistent work, along with patience and strength from their client and his son. Dad has a 10-year-old son. He shares parenting with his ex-wife, from whom he’s been divorced for quite a while. “The boy was living at his mother’s home, but the situation there was, in my opinion, toxic,” says Leving, founder and president of the Law Offices of Jeffery M. Leving Ltd. in Chicago.
According to court documents, the mother constantly called the police and leveled all kinds of specious allegations against Dad, and continually sought medical and psychological care for the boy, but the court found there was no threat of abuse by Dad.
“Dad called us to get his son removed from this environment,” Leving says. “It took a while to convince the judge, but during the hearing, we put on a critical witness – Dad’s adult daughter, who testified that all this meshugas – that’s Yiddish for craziness – happened to her, too. That was persuasive to the judge, who ordered the boy out of the mother’s home and into Dad’s. It appears the judge finally realized that the mother’s complaints of abuse were disproven.”
Leving says this case was a satisfying victory for him and his firm “because it was a tough nut to crack and we finally cracked it. We knew we could not fail.”
It’s also an important victory, modified for broadcast, for Dad and his son, who will now be able to live a peaceful life together, without strain and stress. “I wish them the best,” Leving says.
Leving also will speak about divorces initiated by men – typically about one-third of divorces in the U.S. He says men who file for divorce may be victims of emotional or physical abuse, who may be hesitant to speak up and often find little external support. Men seeking divorce also may be concerned about the safety of their children. “My firm and I have litigated and won many cases where protecting the children was paramount. In a divorce, children should not automatically reside with the mother, especially if we can show the court that placing them there would be harmful to them,” Leving says.
