Leving Keeps Terrified Chicago Father Out of Jail, Safeguarding His Future

A Chicago father turned to attorney Jeffery Leving for help, terrified that he was about to lose everything. The State of Illinois prosecuted dad for thousands of dollars in back child support.
They suspended his driver’s license, froze his bank accounts, and so much more. Even more frightening, he faced the possibility of being jailed if he did not immediately pay what the State claimed he owed.
The Leving litigation team fought for him and won, saving dad from jail and so much more.

Years earlier, dad lived in Texas and, following his divorce, was ordered to pay child support for his child. Dad reported that he paid child support until he lost his job, and when he found work, he continued to make payments, often in excess of the monthly court-ordered amount, in an effort to catch up. Years passed—his child grew up— and is now over the age of 18. Dad remarried and moved to Chicago.
However, dad was shocked when he received a letter from the State of Illinois informing him that his driver’s license had been suspended and his bank accounts frozen. He was told that he could face incarceration unless he immediately paid the child support arrearages the State claimed he owed. The State of Texas was also threatening to take legal action against him, too.
Dad was confused and frantic – he thought he was going to lose everything: his freedom, his job, his ability to provide for his family, and his ability to travel to see his family in Mexico. He felt no one would listen to him and he was ready to give up. He turned to Leving for answers and for help.
The Leving team immediately designed an aggressive legal strategy to protect dad’s liberty and his future. They quickly appeared in court and argued that dad had been wronged, and that the State should never have suspended his driver’s license and frozen his bank accounts.
They won. The judge agreed and reduced dad’s alleged child support arrearage to zero dollars. Dad now has his driver’s license back, his bank accounts unfrozen, and he can use his passport without fear.
This court victory, modified for publication, reflects just how serious a child-support enforcement matter can be. Before retaining the Leving team, dad was headed for jail even though he did everything right! He can now rest easy, knowing he is safe and not at risk of being incarcerated for not paying for child support that he didn’t even owe. He has his liberty, can drive and can travel to Mexico to see his family without the fear of being locked up.
