Leving Team Won for Grandma, Giving Child a Stable Home with His Teen Dad
By: Laura Reichel
A devoted grandmother was in desperate need of help protecting her infant grandchild. The child’s mother had reportedly abandoned the baby, left the state, and was later incarcerated out of state.
The baby’s teen father was doing his best to care for his child with the support of his own mother.
Together, they had provided a stable, loving home, but without the correct court order in place, everything was at risk when the mother was soon to be released.
Chicago based matrimonial attorney Jeffery Leving, President of the Law Offices of Jeffery M. Leving Ltd. will talk about this important case victory and more on the Dads’ Rights Legal Hour, 9-10 a.m. CST Saturday, December 6th on Power 92.3 FM.
This show segment will be available for download on the Dads’ Rights Legal Hour’s Spotify page on dadsrights.com. Listen to this radio show and keep hope alive for all children everywhere by sharing this victory and connecting on Instagram @dadsrights.
Terrified of losing her grandchild, grandma and dad turned to attorney Jeffery Leving for the legal help so desperately needed. Attorney Leving assured them that they came to the right place and that the Leving team would help. Grandma wanted a court order granting her sole possession of the child, and under the law, people who aren’t parents can be awarded parental rights in certain unique circumstances. This is very difficult, but it can be done and was done here. She also wanted decision-making authority, particularly over medical decisions, because even though the baby was healthy, routine medical care would be needed. Her view was that she had a stable home with her son, the child’s father, and there was nobody else who could offer that level of stability.
The Leving legal team moved quickly, filing an emergency petition and appearing before the court. They presented compelling and strong arguments demonstrating the child’s immediate need for safety and stability. They won. The judge granted the grandmother sole possession of the child, as well as decision-making authority over the child and access to the child’s health care benefits.
This important court victory modified for publication was much more than just a legal win; it was a lifeline for a child’s future. Now, the child will remain in a safe, nurturing home under grandma’s possession with dad, who has fully embraced the chance to be the dad his child deserves.
