Kennedy files lawsuit against Meta Facebook for election interference

Independent Presidential Candidate Robert F. Kennedy Jr.and American Values 2024 (AV24), a political action committee supporting Kennedy’s candidacy, today filed a First Amendment and election interference lawsuit against Meta after a biographical film, “Who Is Bobby Kennedy?”, was censored on Facebook and Instagram.

The lawsuit was filed in the U.S. District Court for the Northern District of California against Meta, related entities, and Mark Zuckerberg.

“This case raises important issues about censorship of political candidates by social media giants like Meta,” said Rick Jaffe, Esq., a First Amendment attorney representing Kennedy in the lawsuit.

“I have no doubt this case will set a precedent as Americans increasingly rely on social media to form their opinions and values.”

The lawsuit alleges the defendants censored AV24’s 30-minute film, narrated by Woody Harrelson, about the life of RFK Jr., his environmental activism, and why he’s running for President.

After AV24 released the film on May 3, Meta users could not share or post it on Facebook or Instagram. When trying to post about the film, a variety of different and contradictory explanations were given to users and they were also warned and threatened with adverse consequences for posting about or sharing it.

The lawsuit seeks compensatory and punitive damages, and also an injunction barring Meta from continuing to interfere with the sharing and posting of “Who Is Bobby Kennedy?”

“If supporters of all candidates do not have equal access to the digital public square, then we have a democracy in name only,” Kennedy said. “This goes beyond restricting freedom of expression on issues and ideas. Meta is censoring a biographical film about a major candidate in an election year. How can voters make an informed choice if they are denied basic information about a candidate’s life?”

A PAC supporting Robert F. Kennedy, Jr.’s presidential campaign released a 30-minute biographical film about the life of RFK Jr., his environmental activism, and why he’s running for President.

Who Is Bobby Kennedy?, narrated by actor Woody Harrelson, has already garnered tens of millions of views across multiple platforms.

However, we were quickly flooded with reports of supporters attempting to share the video on Facebook and Instagram, only to find those posts censored!

Sometimes, the pathetic reason given by Facebook was that it’s a malicious website or spam. Otherwise, reports show examples of the video being flagged as containing ‘nudity’ or ‘graphic and violent content,’ violating community standards, or a simple warning message of ‘upload error’ (see screenshot evidence).

This biographical film on RFK Jr. is being blatantly censored. If supporters of all candidates do not have equal access to the digital public square, then we are only living in a democracy in name only!

It’s clear that Meta — the parent company of Facebook and Instagram — is terrified of Team Kennedy’s message of hope and an alternative from the corrupt two-party system.

Now, we’re suing Meta in the U.S. District Court for the Northern District of California. We will not let Meta users silence our supporters!
