A Native American Father’s Rights Upheld, A Family’s Heritage Preserved

The moments a father shares with his children are priceless, shaping memories that last a lifetime. Sadly, not every father is given the chance to be there when it matters most.
A devoted father was faced with this heartbreaking reality when his ex reportedly kicked him to the curb, denying him the opportunity to see his child.

Dad, a Native American who lives on the reservation, has always been deeply involved in his child’s life, even after separating from the mother. However, the mother moved away with the child. She reportedly refused to allow him any parenting time on the reservation and made a series of damaging accusations, including claiming that dad planned to abscond with the child. For a father who only wanted to love and be present for his child, these allegations were devastating. Fearing that the mother would not relent, dad turned to attorney Jeffery Leving for help.
The Leving legal team fought fiercely for dad and his child in court, making it clear that dad wanted nothing more than the opportunity to spend meaningful time with his child in his home. They asserted to the court that the mother’s accusations were unsupported. They won. The judge granted dad parenting time with his child, including time on the reservation, as well as joint decision-making authority over important medical and religious matters.
This important court victory modified for this publication not only protected this father’s rights but also hopefully reinforced the broader principle that all fathers deserve equal justice and recognition under the law. Now, dad can help raise his child within the traditions of his reservation, a powerful victory for both fathers’ rights and cultural identity.
Matrimonial attorney Jeffery M. Leving is the recipient of the Presidential Lifetime Achievement Award from the President of the United States in recognition of 7,500 hours of service to this nation. In addition, the Illinois House of Representatives has honored Leving “for his work in safeguarding the rights of fathers and protecting the welfare of children and families in this State,” and the Illinois Senate issued a proclamation recognizing his efforts on behalf of fathers.
