Court orders wife to stop selling marital assets
The father of a 7-year-old girl was rightfully upset when the child’s mother sold a very rare and expensive antique car that the couple acquired while married without his knowledge or consent and without sharing the proceeds.
Attorney Jeffery Leving, founder and president of the Law Offices of Jeffery M. Leving Ltd. in Chicago, will talk about this father’s case on his weekly radio show, the Dads’ Rights Legal Hour, 9-10 a.m. CDT Saturday, September 23, on Power 92.3 FM in Chicago.
When the couple was together, they acquired many very rare antique cars as both a hobby and investment. However, once they separated, the mother decided to sell one of the cars and instead of depositing the proceeds in their joint account, she had the money deposited into her own account without the father’s knowledge or consent.
The father, fearing that she would continue this type of activity, came to us for help to put a stop to it in order to ensure that any funds from antique car sales would be shared equally, as the cars were acquired during the time they were married and are marital property.
The father wants to ensure that the proceeds from any sales are shared so that they can be used to pay for childcare and for college savings for his daughter and more.
Jeffery M. Leving appeared in court and told the judge what was happening.
The result was a victory for Dad and the Leving legal team. After reviewing the pleadings and evidence, the judge entered an order requiring the mother to immediately stop selling any antique cars. The mother was also ordered to provide the court a full accounting of the funds that she received after selling the antique car that she did sell.
“We won,” Leving says. “This is an important victory, modified for broadcast. Through our efforts, we ensured that this mother could not continue to act irresponsibly and ensured that any proceeds made from selling off any rare and expensive antique cars would be safeguarded.”
If this victory sounds similar to others Leving has discussed on his weekly broadcast, it’s not your imagination. Many fathers come to the Leving firm complaining that their child’s mother has acted irresponsibly with what should be shared funds, fearing there won’t be money for the child if not stopped. Often times, appealing to a former’s spouse good nature does not cut it. What is needed is an attorney to fight for justice and that’s what Leving has been doing for decades.
