Dad wins in court vs. relatives to recover his children and bring them home

A loving father whose relatives turned against him needed legal help to prevent his children from being taken away from him.

Renowned Fathers’ Rights attorney Jeffery M. Leving, whose firm won in court on behalf of this father, will talk about the case on his weekly radio broadcast, the Dads’ Rights Legal Hour, 9-10 a.m. CDT Saturday, Aug. 12 on Power 92.3 FM in Chicago.

Dad is the father of two boys, ages 10 and 8, who has enjoyed sole custody of both for almost their entire lives. Dad and his boys live in Connecticut – but last year, his employer sent him on assignment out of state for one year.

Thinking he could trust his children’s maternal aunt and uncle – since they had been active in the children’s lives – Dad decided to allow his kids to stay with them temporarily for a year in Illinois.

However, it was reported that the aunt and uncle appeared to begin to emotionally alienate the children from their father, and manipulate them into thinking it was better to stay with them. They ultimately tried to keep the kids after the one-year period was over.

 

The aunt and uncle fought Dad in court for the boys, saying that they could provide a better environment than their father could.

“Fortunately, Dad had us fighting for him,” says Leving, founder and president of the Law Offices of Jeffery M. Leving Ltd. in Chicago. “In court, we said no to the aunt and uncle’s contention. We said the children were doing great when living with their father, and are eager to return to their picture-book New England town with Dad, and to go back to school with their old friends.”

Furthermore, the Leving legal team asserted that a good father has the fundamental right to parent his own children – a right that is superior to aunts and uncles, grandparents and whoever else.

“The judge agreed,” Leving says. “We won. The judge ordered the aunt and uncle to turn the boys over to our client, and they did. This is an unusual case, and an important victory, modified for broadcast, which places these children back with their dedicated and loving father, where they belong.”
