Baseless Order of Protection Vacated, Father and Daughter Reunited

No father should ever need to fight against a baseless Order of Protection to be in his child’s life.

Yet for one devoted father, that’s exactly what happened when the bond he cherished most with his daughter was suddenly torn away. 

Dad became desperate after the mother of his child secured an Emergency Order of Protection against him, left him without a home, and cut him out of his daughter’s life.

Terrified of losing his daughter forever, his home, and his entire future, dad turned to attorney Jeffery Leving. The Leving legal team fought for him and won, vacating the Emergency Order of Protection, securing dad’s future with his daughter, and so much more.

Dad and the mother were never married but lived together with their six-year-old daughter. Out of the blue, the mother reportedly physically assaulted dad, who in self-defense necessarily restrained her. However, she later secured an Emergency Order of Protection against him, claiming he had attacked her. Overnight, dad was immediately kicked out of his own home, barred from seeing his daughter, and had nowhere to go. For months, dad was afraid that he would lose everything that mattered most.

Unwilling to give up, dad turned to attorney Leving and his legal team to save and protect his relationship with his daughter and their future together.

Time was of the essence, and the Leving legal team knew they had to act quickly. In court, they fought fiercely, proving it was the mother, ​not dad, who had been the aggressor. They won. The judge agreed with their arguments, finding the Emergency Order of Protection baseless and improper and vacated it. This was a significant victory for dad. Vacating the Emergency Order of Protection meant that the Court’s initial finding of abuse was not substantiated as a matter of law and as such, this Order was void from its beginning.

This important court victory modified for publication cleared dad’s name, protected his career, and most importantly, reunited a father and daughter who had been torn apart from each other.
