Court vacates order of protection, reuniting dad and daughter

The bond between a father and his child is irreplaceable. When that bond is threatened, the stakes could not be any higher.  A devoted father was horrified to discover that his ex had filed and obtained an order of protection against him under what appeared to be false pretenses, putting his liberty at risk. Fearing that he would end up in jail and never see his daughter again, dad called attorney Jeffery M. Leving for help. It was a fierce, uphill battle but Leving and his legal team won, protecting dad’s bond with his daughter and setting them on the path of reunification.

The situation began when dad was at a park playing tennis. To his surprise, his eight-year-old daughter appeared all alone. Although dad was confused as to why his daughter was out alone, he spent time with her and then responsibly walked her back to her nearby home. However, the child’s mother came out of her home, and it was reported she physically attacked dad before slamming the door behind her.

The mother later filed and obtained an emergency order of protection against dad—placing the daughter on the order as a protected party. This stripped dad of the ability to see his child and threatened to poison the little girl’s perception of her loving dad, creating the devastating risk of parental alienation and more.

Terrified of going to jail and never seeing his little girl again, dad called attorney Leving for help. Attorney Leving assured dad that he and his legal team would fight for him and his daughter.

After a tough battle in court, the Leving legal team won. The judge saw that the mother’s claim lacked merit and vacated the emergency order of protection, allowing dad to see his daughter again without fear of being jailed.

This important court victory modified for publication was more than just a legal win. It’s a profound step toward repairing a relationship unjustly fractured. There was no reason to keep this father away from his daughter, and dad can now work on healing his relationship with his daughter without fear. The fight for a father’s right to be in his child’s life is never easy, but it’s always worth it. Victories like this are not just legal wins, they are lifelines for families and proof that truth and perseverance can overcome even the toughest odds.

Matrimonial attorney Jeffery M. Leving is the recipient of the Presidential Lifetime Achievement Award from the President of the United States in recognition of 7,500 hours of service to this nation. In addition, the Illinois House of Representatives has honored Leving “for his work in safeguarding the rights of fathers and protecting the welfare of children and families in this State,” and the Illinois Senate issued a proclamation recognizing his efforts on behalf of fathers.
