Chicago dad’s court victory kept sons safe at home

A terrified Chicago dad feared losing his children forever after their mother threatened to take them from him. Dad was horrified at possibly losing his boys forever.

The Law Offices of Jeffery M. Leving, Ltd. fought for them in court and won, safeguarding dad and his children, keeping them where they belong – together.

Dad was divorced with residential custody of his two boys, ages ten and twelve. Dad encouraged his children to spend time with their mother, allowing them to have unsupervised phone calls. Out of the blue, the mother announced she had moved out of Illinois.

Dad finally discovered that his ex had planned to pick the children up and take them with her to California. According to court documents, the mother never informed dad of her plans. Dad feared she’d never return, and he’d lose his children forever.

Dad was terrified – he feared that if his ex succeeded in taking the boys, he would never see them again. Dad immediately called attorney Leving for help and got it. 

The Leving team litigated the case to victory on behalf of this dad and his young children arguing that not only was dad their primary caretaker, but the young boys also had a strong support network of friends and family in the community they lived in with their father.

Leving pointed out that removing the children from their home and community, from a safe environment, could cause irreparable harm to the children’s mental and emotional health. The judge agreed and ordered that the boys not be removed from Illinois. The judge also ordered that the mother not remove the children from school.

This was an important court victory, modified for publication, that helped protect a dad and his sons and prevented the children from being ripped away from their home. Dad and his boys are exactly where they belong: together.

Matrimonial attorney Jeffery M. Leving is the recipient of the Presidential Lifetime Achievement Award from the President of the United States, in recognition of his 7,500 hours of service to this great Nation. In addition, the Illinois House of Representatives has honored Leving “for his work in safeguarding the rights of fathers and protecting the welfare of children and families in this State,” and the Illinois Senate issued a proclamation recognizing his efforts on behalf of fathers.
