Judge grants struggling father relief from ‘unconscionable’ pre-nuptial agreement

Prenuptial agreements are meant to lay out how individuals entering a marriage will divide their assets in case of divorce.
While the main goal is to protect an individual’s assets in case of divorce, there are times when they are used to take advantage of the people signing them, which is wrong.
This was the case for a struggling and divorcing father, who found himself being used and dumped by his soon-to-be ex-wife.

Dad had signed the prenuptial agreement when he was a poor student, with no knowledge of his future wife’s substantial assets. Not only was Dad not given adequate disclosure of his future wife’s finances at the time of signing, it appears that the future wife had actively hid important information from Dad. With the divorce now being litigated, Dad felt he was being dumped on the side of the road.
Desperate, he called the Law Offices of Jeffery M. Leving Ltd. for help. The Leving legal team assured Dad that they would fight for him, and they did.
This was a tough case for the Leving team as they were in a Downstate courtroom going up against a lawyer who was well known and respected locally. However, the Leving team did not give up. They prepared with thorough discovery, including deposing the adverse party, and even a witness to the signing of the agreement.
The hearing was lengthy and involved several witnesses, but the Leving legal team won. The judge granted the petition to invalidate the prenuptial agreement. The Leving team was able to prove that not only was there inadequate disclosure, but also there were irregularities in the execution of the prenuptial agreement itself, and the prenuptial was unconscionable, considering the financial positions of the parties.
This was an excellent, hard-fought victory by the Leving legal team, modified for broadcast, on behalf of a desperate father who was being taken advantage of. Furthermore, this victory demonstrated the importance of having strong legal representation in important matters such as prenuptial agreements. The Leving team fought for this father in his time of need and never gave up.
