Dad and his ex were never married. After their separation, dad and his daughter were forced to leave the home they once shared with the mother. Dad raised his daughter in a happy, stable environment, surrounded by a supportive community. Despite never denying his ex parenting time, the mother rarely visited their daughter. Out of the blue, the mother called to say she wanted to spend the weekend with the young girl. Dad agreed on the condition that the mother would bring their daughter back home in time for school.
To dad’s horror, the mother refused to bring her back home after her parenting time. Not only did the mother fail to send the young girl back to school, but she also isolated and alienated the child from her father, her school, and her community. Dad had no way to even contact or find his little girl.
Terrified at the thought of never seeing his daughter again, dad immediately called for help and got it. The Leving legal team fought fiercely to reunite him with his daughter and protect her future.
The Leving team demonstrated to the judge that although dad had never denied parenting time, the mother rarely visited or spent time with their daughter. They argued that not only had the mother kidnapped the child, but she had also isolated her from her extended family and community and interfered with her schooling—endangering her academic future. They won. The judge ordered the child be returned to her father’s home immediately and granted dad permission to utilize local and state law enforcement to ensure his daughter’s safe return.
This crucial court victory, modified for publication, reunited a loving father with his little girl and protected her future. Dad can continue raising and caring for his daughter, without fear of losing her forever.
Matrimonial attorney Jeffery M. Leving is the recipient of the Presidential Lifetime Achievement Award from the President of the United States in recognition of 7,500 hours of service to this nation. In addition, the Illinois House of Representatives has honored Leving “for his work in safeguarding the rights of fathers and protecting the welfare of children and families in this State,” and the Illinois Senate issued a proclamation recognizing his efforts on behalf of fathers.
